Murphy PC Advises Borrower in Commercial Property Refinancing in Nantucket, Massachusetts

December 10, 2025-Murphy PC represented a borrower limited liability company, an affiliate of a real estate investor managed by the investor’s family office, in connection with the refinancing of a commercial property located in Nantucket, Massachusetts. The retail property is leased to a national residential brokerage firm.

The borrower is an affiliate of a private real estate investor whose portfolio is managed through a family office structure. The family office oversees a diversified portfolio of various real estate investments in Massachusetts and other select markets, with a focus on long-term ownership of high-quality assets.

The transaction involved negotiating comprehensive loan documents with a regional lender, as well as coordinating tenant-related agreements essential to the refinancing. Murphy PC also served as title counsel, issuing a lender’s title insurance policy and related endorsements.

The refinancing required close coordination among the borrower, lender, and tenant, including negotiation of a subordination, non-disturbance and attornment agreement and an estoppel certificate to ensure the lender’s security interest while preserving the tenant’s occupancy rights under its existing lease.
