Murphy PC advised the landlord in negotiating a commercial retail lease for a new lobster and seafood dining concept at a destination shopping and dining center in Kittery, Maine. The suite adds an experiential food-and-beverage use to a center that draws both year-round shoppers and seasonal visitors. It strengthens the property’s dining offering and supports traffic across the tenant mix.
We counseled the client on structuring a lease suited to the operational demands of a food-and-beverage tenancy while protecting the landlord’s interests in the center as a whole. Throughout the negotiation, we advised on rent structure, term and renewal options, and permitted use and exclusivity provisions. We also advised on delivery condition, the tenant improvement allowance, and landlord approval rights over the kitchen buildout, including venting, grease management, and utility capacity. Other terms covered operating covenants, signage, and seasonal considerations. By keeping business and legal terms aligned and working closely with the client, brokers, and tenant’s counsel, we helped the parties reach signing on the client’s intended schedule.
